Acceptance of Terms

By accessing and using Fête (fete.rsvp), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Fête is owned and operated by Bonsai Tech LLC ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of our platform, website, and services.

Description of Service

Fête is a digital invitation platform that allows users to create events, invite guests, collect RSVP responses, and manage event details. Our service includes:

• • Guest invitation and RSVP collection
• • Image hosting and management
• • AI-powered invitation copy generation
• • Free and paid subscription tiers

Fête operates on a freemium model with optional paid subscriptions (Pro at $12/month or $99/year). Services are provided "as is" and may be subject to change at our discretion.

User Accounts

To use Fête, you must create a user account and provide accurate, current, and complete information. You are responsible for:

• • Maintaining the confidentiality of your password and account information
• • Restricting access to your account from unauthorized individuals
• • Accepting responsibility for all activities that occur under your account
• • Promptly notifying us of any unauthorized use of your account

You represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. You may not create multiple accounts or use another person's account without permission.

Acceptable Use

You agree not to use Fête for any unlawful purpose or in any way that could damage, disable, or impair our platform. Specifically, you may not:

• • Harass, threaten, defame, or abuse other users or third parties
• • Upload or distribute malware, viruses, or other harmful code
• • Attempt to gain unauthorized access to our systems or networks
• • Use automated tools to scrape, crawl, or spider our platform

• • Infringe upon intellectual property rights
• • Impersonate another person or entity

We reserve the right to investigate and take appropriate action against users who violate these policies.

Intellectual Property

Fête and its entire contents, features, and functionality (including all information, software, text, displays, images, video, and audio) are owned by Bonsai Tech LLC, its licensors, or other providers of such material and are protected by copyright and trademark laws.

You are granted a limited, non-exclusive, non-transferable license to access and use Fête solely for your personal or internal business purposes. This license does not include the right to:

• • Modify or create derivative works
• • Copy, reproduce, or distribute content without permission
• • Remove or alter any proprietary notices
• • Transfer or sublicense your rights

User Content

You retain ownership of all content you upload, create, or submit through Fête ("User Content"), including event details, images, and invitation text. By uploading User Content, you grant Fête a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content solely for the purpose of providing our services.

You represent and warrant that:

• • You own or have permission to use all User Content
• • Your content does not infringe third-party rights
• • Your content does not violate applicable laws
• • You have the right to grant us the licenses stated herein

We may remove content that violates these Terms or applicable law, and we are not responsible for User Content that is lost, deleted, or corrupted due to system failures.

AI-Generated Content

Fête offers AI-powered invitation copy generation using Claude AI technology. Content generated by our AI tools is provided to assist you in creating invitations. You are responsible for reviewing and editing AI-generated content before use.

We disclaim responsibility for the accuracy, appropriateness, or copyright compliance of AI-generated content. You assume full responsibility for any use of generated content that may infringe third-party rights or violate applicable law.

Payment Terms

Fête offers the following subscription options:

• • Free Plan: Limited features at no cost
• • Pro Plan: $12 per month or $99 per year

Payment is processed through Stripe, a third-party payment processor. By providing payment information, you authorize us to charge your account for the selected plan. You agree to maintain accurate and current billing information.

Billing and Renewal:

• • Monthly subscriptions renew automatically on the same date each month
• • Annual subscriptions renew automatically on the same date each year
• • You may cancel your subscription at any time; cancellation becomes effective at the end of your current billing period
• • No refunds will be issued for partial months or unused portions of your subscription

We reserve the right to change pricing with 30 days' notice. Changes will not affect your current billing period.

Termination

You may terminate your account at any time by contacting us at mitul@bonsaitech.net or through account settings. Upon termination:

• • Your access to Fête will be immediately revoked
• • You remain responsible for any charges incurred before termination
• • We may delete your User Content in accordance with our data retention policy

We may suspend or terminate your account at any time for:

• • Violation of these Terms
• • Non-payment of fees
• • Unauthorized or fraudulent use
• • Any other reason at our sole discretion

Upon such termination, your license to use Fête immediately ceases, and we may retain User Content as required by law or as described in our Privacy Policy.

Disclaimer of Warranties

FÊTE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, BONSAI TECH LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) our service will be uninterrupted or error-free; (b) defects will be corrected; (c) User Content will be secure or not lost; or (d) the service will meet your expectations. Your use of Fête is at your own risk.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BONSAI TECH LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA, OR PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE, OR OTHER TORT.

Our total liability to you for any claim arising out of or relating to these Terms or Fête shall not exceed the total amount you have paid to us in the 12 months preceding the claim, or $100, whichever is greater.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, and any disputes shall be subject to the exclusive jurisdiction of the courts located within the United States.

You agree not to initiate any legal proceedings against Bonsai Tech LLC unless you have first attempted to resolve the dispute informally by contacting us at mitul@bonsaitech.net.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes via email or through a prominent notice on the Fête website. Your continued use of Fête following such notification constitutes your acceptance of the updated Terms.

It is your responsibility to review these Terms periodically for changes. If you do not agree to any modification, you must stop using Fête.
